Wrongful termination?
I work as a waitress at a restaurant. I live near Toronto and my boyfriend lives in Buffalo. If I have a couple days off I will drive 2.5 hours and stay with him and return when I have to work. On Thursday I was in Buffalo and had to work at 5:30pm. I left at 1:00pm, this would give me 5 and a half hours to do the 2.5 hour drive and I also had all my work stuff with me incase I didn't have enough time to get home first. I don't know my way around Buffalo very well I use my GPS.. About 5 miles from the boarder there was construction and I was forced to get off the highway. Suddenly my GPS was not working. It just couldn't get any signal (I'm uming due to the power outages from the wind storm). I immediately started calling everyone who I work with begging them to cover my shift. No one would take it. So I figured I'm only 5miles away I can make it there on my own. It was about 2:00 at this point. By the time I make it to the boarder its 3:00. I took many wrong turns and it was very stressful but I thought I still might make it. To my surpise they had closed the bridge due to the wind. I know that the nearest bridge is at least 20minutes away IF i knew how to get there without my GPS. Which means I would be stuck in traffic also and never make it on time. I called work and decided not to call in sick and tell them my situation. My manager replied by telling me to call his daughter and tell her he was going to miss her concert because I can't make it in to work, than told me how rediculous it is that I can drive to Buffalo every week but can't make it into my shift. I have been working there 7months and have only called in sick twice. I've been late very few times and have never recieved a write up. I came into my shift on Saturday and was told that I was being let go because I was not dependable. They said they went back in my file and I had a shift switched wrongly because the person taking my shift called the night before and told them I was taking it and I did not call myself. My response was "I switch shifts all the time and thats how I always do it I should be in that book a lot more than once than". He had no answer to that. They said I would be getting a weeks pay. But who knows how much that will be. I'm a server I work few hours and its very inconsistant I can work anywhere from 5-25 hours in a week. Also I know many other people who call in sick an hour before their shift and have no reprocussions, or miss the shift completely and call after. Is this a wrongful dismissal? If it is what would I get for going to the labor board? Also the manager who fired me grabs my *** and everyone elses and hugs us all the time. He is our friend and I've never had a problem with it. I mean everyone at work is inappropriate even myself. Not with him tho except for things I say infront of him.
