Can I go to jail for first DWI offense?

It depends on the judge if you go to jail or not but if you knew that you would have past the breathalyzer test then you should have took it then you would have got to go on your way back home, and since you didn't want to take it because of your "rights" it makes it seem like you were drunk and had more then 1 beer.
